Nespresso Connected Machine - EU Data Act Notice

Nespresso is committed to ensuring that your personal data is handled in accordance with applicable regulations, providing you with transparency and control over your information.

As a valued owner or prospective buyer, the following Notice will help you to understand the data generated by your machine and App, and your rights regarding these data. Please note that the exercise of these rights as detailed in this document, is applicable to individuals subject to European law under the EU Data Act.

This Notice explains how we deal with technical data that is generated when you use your Nespresso machine and app. It also details how you may ask us to share such data with you or a third party in line with the EU Data Act. If you are looking for information on how we process your personal data, you will find this information in our Privacy Notice. Our Privacy Notice applies independently of this Notice.

1. Your coffee machine and the Nespresso app generate and store data

Some connected Nespresso Machines create data related to their use (“Machine Data”) and they can communicate this information via an electronic interface. This is relevant for the following machines:

  • Vertuo Creastista
  • Vertuo Latissima
  • Vertuo Next CR
  • Vertuo Next Legacy
  • Vertuo Pop
  • Vertuo Pop+
  • Barista - Milk Receipt Machine

Similarly, when you connect a Nespresso Machine to the Nespresso app, the app may create information about what the user does or happens on the Nespresso Machine (“App Data”).

 

2. Which Machine Data does my Nespresso machine generate?

Your connected Nespresso Machine may be able to generate the following Machine Data:

Please note that not all connected Nespresso Machines can generate all the above Machine Data, and the available Machine Data depends on how you use your Nespresso machine.

The estimated volume of the data that your Nespresso machine can generate depends largely on how you use it. As a rough indication, each preparation of a cup of coffee generates approximately 50 KB of Machine Data

Machine Data will be stored on your Nespresso Machine once it has been generated. Your Nespresso Machine may be able to generate such data continuously and in real time. When you connect your Nespresso Machine via the Nespresso app or via WiFi, Machine Data will also be transferred to and stored on Nespresso servers.

 

3. Which App Data does the Nespresso App generate?
    (currently Nespresso App isn't available in Finland)

The Nespresso Machine is able to generate the following App Data:

Please note that the App Data generated by the Nespresso app depends on the type of Nespresso Machine you have and how you use it.

Some App Data contain our trade secrets. This means that we may not be able to share such Data with you or a third party upon your request, or only if you (and/or the data recipient) agree to and implement technical and organizational measures for the protection of our trade secrets.

 

4. How we store, use, retain and share Machine Data and App Data

When we receive Machine Data and/or App Data as described at sections 2. and 3. of this Notice, we will store them on Nespresso servers. We will retain Machine Data and App Data on our servers for 10 years.

We use readily available Machine Data and App Data to improve Nespresso Machines and the Nespresso app as well as for business analytical purposes.

We do not intend to allow third parties to use readily available Machine Data and App Data. Your right to request that we share data with a third party, as described in section 5 of this notice, remains unaffected.

 

5. Data sharing

You may request that we share Machine Data and App Data generated by your Nespresso Machine and the Nespresso app, either with you or with a third party designated by you.

You may submit a data sharing request by contacting us in writing as described in section 6 of this Notice. Such request should indicate which data you intend to access or retrieve, and to whom the data shall be made available.

When we receive a data sharing request, we will verify whether you qualify as a user of the Nespresso Machine or app mentioned in the request. We may also request that you submit the relevant documentation to prove your authorization to access and retrieve the requested Machine Data and/or App Data.

In accordance with Article 3(1) and Article 4(1) of Regulation (EU) 2023/2854 (the “Data Act”), Nespresso has opted to implement an indirect data access model. Users shall not be granted direct access to the connected products or related services. Instead, data shall be made available upon request, in a structured, machine-readable format, and in accordance with the modalities defined in this Agreement.

Whenever we share Machine Data and App Data with you, we will provide such data ‘as is’. We cannot and do not assume any responsibility for the quality of the data, including its accuracy, completeness and usefulness for any intended purpose.

 

6. How to contact us and how to complain

Please address any questions, applications and issues relating to your possible rights under the EU Data Act to Perroy Fi Oy, Official distributor of Nespresso in Finland. Itämerenkatu 1, 00180 Helsinki, Finland.

If you believe that we have infringed any of the provisions of Chapter II of the EU Data Act, you may lodge a complaint with the competent authority (as designated pursuant to Art. 37 Data Act).

 

7. Amendments of this Notice

We reserve the right to change our approach to how we handle Machine Data and App Data. This Notice may be updated periodically to reflect any such changes. We suggest that you check this Notice regularly for updates.
